Father is Gone, Mom Mesothelioma: Is Bankruptcy an option?
My father was exposed to asbestos at work that lead to him contracting the deadly disease, eventually leading to premature death. The symptoms of mesothelioma are non-specific and it took more than 30 years to appear from the time he was exposed to asbestos in the workplace. The symptoms were shortness of breath and severe chest pain due to accumulation of fluid around his lungs. It also led to him losing weight.
Now my mother has developed mesothelioma because they treated clothing. In spite of this disease are quite rare, it can be developed, even if a family member is exposed to asbestos and brings it home on the clothing. It can affect family members through secondary exposure, as that happened in my family. Although more common in men than in women and risk of the development is more for older people, there are chances that it can appear in both men and women at any age.
If my mother has this disease, there are only a few options for me to make the family financially to take. One option is to court cases file against the company where my father was exposed to asbestos. Now, many states have enacted laws to enable families to claim against the employer of the victim. The lawsuit must be filed within a certain time frame. I can claim for a variety of effects, including:
- Medical expenses for treatment of my mother
- Rehabilitation costs
- Lost wages after the death of my father
- The earning from my father, he was healthy
- Psychological trauma and emotional pain

After filing of court against the company, it will be necessary to prove the following:
- Confirmed diagnosis of mesothelioma
- That my father was exposed to asbestos in the workplace and my mother developed the disease through secondary exposure
- My father's employer was responsible for the exposure
Bankruptcy as an option in mesothelioma
When my parents developed this deadly disease, I thought of the possibility of bankruptcy. However, I'm able compensation prior to going to a bankruptcy. I would not have been eligible for reimbursement of the following reasons:
- The case of my father the disease is too old, because the state and federal laws require legal claims for asbestos related illnesses to perform within a short time after the diagnosis. By law must be done within 1-3 years from the time of diagnosis or death.
- If the employer company is bankrupt and without any means, can not claim compensation unless it was taken over by another company. To avoid compensation for the families of those affected, most companies to declare bankruptcy protection in spite of having millions of dollars with them.
Choosing a capable lawyer to fight your case will help in obtaining thousands of dollars. So it is better to go for the option of claiming compensation, where is the probability of settlement rather than looking at the possibility of filing bankruptcy.
